The First Amendment and Punishing Speech

We discussed how the First Amendment affects our view of free speech versus what our ethical view of what freedoms should be allowed. In the Fitzpatrick text, it's noted that…" As Justice Powell observed, First Amendment protection is determined by “the inherent worth of the speech in terms of its capacity for informing the public.” At the same time, the Court has recognized the need to protect the sanctity of the marketplace in situations where speech “threatened imminently to undermine democratic processes.” Thus, the Court has allowed certain speech restrictions intended to safeguard the efficient functioning of government."

Our social networks, like Facebook, have come under fire for allowing and, in some cases, then removing misinformation. In fact, Vox went as far as to state the First Amendment has a Facebook Problem. Review the readings for this week and determine if the First Amendment a guide for ethical behavior. Why or why not?
