When discussing any county’s Constitution (although some don’t have one, like Britain), it helps to compare it others. For example, as I mentioned in class, the U.S. Constitution has seven Articles, while India’s Constitution has 395. Each country can make their Constitution any way they want to. In your essay, please compare the U.S. constitution to another country’s.
There is the question of weather the Constitution is a “living” document, which requires judicial interpretation, or if Justices should read it plainly and follow its “original intent,” which means the Constitution is not open to new interpretation, Please – at least briefly, but at length if it interests you – discuss your view on this point.
When I say: Please explain… what the Constitution is, and what it does,” this means to analyze it – to break it down into its significant parts and summarize and paraphrase, as needed (yes, you must decide)
I also want you to discuss this question: Should the U.S. Constitution stay as it is, or should we throw it away and write a new one for the 21st century? You must also use Louis Seidman’s article, somehow, in your essay.
How you organize your essay, how you discuss these point, is up to you. The main thing, of course, is that your essay is clear and compelling.
