“Judges as Policymakers”
Begin your research by reading the section entitled “Judges as Policymakers” in pages 487-490 (Chapter 15) of your textbook. Then review the two power point slides on the subject included in the slide copies for the federal judiciary (Exam 3 Slide Copies). Finally, read this summary of the pros and cons of judicial activism and restraint. Feel free to conduct your own research on the topic as well. As you conduct your research, make note of the arguments for and against these competing judicial approaches, and consider which judicial approach you tend to favor, and why.
- Define, and thoroughly explain the key distinctions between the philosophies of judicial activism and judicial restraint.
- Cite and explain what you consider to be the primary strengths and weaknesses of these two competing judicial philosophies.
- Indicate which judicial approach you favor, and clearly explain why you believe this judicial approach is preferable to the alternative.
