There are many different types of civil wrongs. Sometimes liability comes from acting in an unlawful act; other
times from an action which is legal but improperly performed, and still others liability can arise from failing to
act where duty required action. These types of wrongs are commonly referred to as mis-, mal-, and nonfeasance, respectively.
Veridian Credit Union brought a class action lawsuit against Eddie Bauer in the wake of Eddie Bauer’s 2016
data breach. Hackers stole credit card information from Eddie Bauer. This, in turn, forced Veridian to incur
costs related to theft of payment-card information of Veridian customers. Veridian alleged that the retail store
employed lax security practices. Despite Veridian being a third party to the theft, the case was allowed to move
through the court system. The parties disputed what, if any, duty was owed and whether that duty had been
fulfilled.
