Use the case index located at the end of your textbook to find a case that can be used to identify constitutional
laws that have impacted the justice system. Your instructor will approve your selected case or your instructor
may assign a case to each student to avoid duplication. You will need to do some additional research on your
case using the Internet and other sources in order to answer the questions below. In a written paper include the
following:
• What was the case about?
• What were the outcomes of the case?
• How was our justice system changed by this case?
• Why is the case a criminal case and not a civil case?
• How do the two types of cases differ?

In some states, judges are allowed to add a boost to nearly hung juries by recharging them under a set of
instructions that the Supreme Court put forth in the 1896 case of Allen v. U.S.99 The Allen charge, as it is
known, urges the jury to vigorous deliberations and suggest to obstinate jurors that their objections may be illfounded if they make no impression on the other jurors. If the jury remains hung, then it is up to the state to
decide whether or not to retry the defendant.
